WAIVER OF LIABILITY AND RELEASE AGREEMENT, ASSUMPTION OF RISK, AND RELEASE AGREEMENT

For purposes of this Agreement, each adult or minor identified above who participates in any Born Strong Martial Arts activity is a “Participant.” “I,” “me,” and “my” refer to the adult signing this Agreement. If I am signing as the parent or legal guardian of a minor Participant, I sign for myself and, to the fullest extent permitted by law, on behalf of that minor. Each adult Participant must complete and sign a separate Agreement.

  Voluntary Participation and Covered Activities: I voluntarily choose to participate and/or permit each minor Participant identified above to participate in programs and activities offered, sponsored, organized, hosted, or supervised by Born Strong Foundation Inc. dba Born Strong Martial Arts (“Born Strong Martial Arts”). Covered activities include, but are not limited to, martial arts classes and training; Taekwondo, Krav Maga, Muay Thai, kickboxing, grappling, self-defense, sparring, partner drills, belt testing, demonstrations, workshops, seminars, camps, tournaments, open houses, community programs, fitness and conditioning activities, special events, and activities conducted at recreation centers, schools, partner organizations, host facilities, or other locations.          

 Health and Fitness: To the best of my knowledge, each Participant is physically able to participate safely. I agree to disclose any known medical condition, injury, allergy, medication, disability, physical limitation, or other circumstance that may affect safe participation. I understand that Born Strong Martial Arts does not provide medical diagnosis or medical advice and that I am responsible for consulting an appropriate medical professional when necessary before participating.

 Assumption of Risk: I understand that martial arts, self-defense, fitness, and related activities involve inherent and other risks. Activities may include strenuous exercise, running, jumping, stretching, striking, kicking, punching, blocking, sparring, grappling, throwing, falling, rolling, partner drills, physical contact, use of pads or other training equipment, and contact with floors, walls, equipment, instructors, volunteers, or other Participants. Risks include, but are not limited to, bruises, cuts, abrasions, muscle strains, sprains, dislocations, fractures, dental injuries, eye injuries, head injuries, concussions, neck or back injuries, joint injuries, illness, dehydration, cardiovascular events, permanent disability, paralysis, and death. Injuries or losses may result from the Participant's own actions, the actions of another person, physical exertion, equipment, environmental or facility conditions, or the acts or omissions of instructors, employees, independent contractors, volunteers, or others. I knowingly and voluntarily accept and assume these risks for myself and for each minor Participant for whom I am legally authorized to sign.

THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, WILLFUL OR INTENTIONAL MISCONDUCT, OR ANY CLAIM OR RIGHT THAT CANNOT LEGALLY BE WAIVED. 

Emergency Medical Treatment: If a Participant becomes injured or ill during a covered activity, I authorize Born Strong Martial Arts and its representatives to provide reasonable first aid, contact emergency medical services, and arrange emergency medical evaluation, treatment, or transportation when reasonably considered necessary. I understand that Born Strong Martial Arts does not guarantee the availability or outcome of medical treatment. I accept responsibility for medical, ambulance, transportation, hospital, or other healthcare expenses incurred for myself or for any minor Participant for whom I am signing.
Severability: If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.
Texas Law: This Agreement shall be interpreted under the laws of the State of Texas, without regard to conflict-of-law principles.

Acknowledgment of Understanding: I HAVE CAREFULLY READ AND UNDERSTAND THIS AGREEMENT. I UNDERSTAND THAT MARTIAL ARTS AND RELATED ACTIVITIES INVOLVE RISKS OF SERIOUS INJURY AND THAT I AM GIVING UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR CLAIMS COVERED BY THIS AGREEMENT. I SIGN THIS AGREEMENT KNOWINGLY AND VOLUNTARILY. IF I AM SIGNING FOR A MINOR, I CONFIRM THAT I AM THE MINOR'S PARENT OR LEGAL GUARDIAN OR OTHERWISE HAVE LEGAL AUTHORITY TO SIGN.
